A Sunday In Central Oregon


Today was the second day of the opening weekend of fishing season in Oregon.  As promised to my husband I spent the day with him.  I did not realize how much I needed a day to rejuvenate and re-charge my batteries.I often tease that my husband and I have very few things in common - but one thing we do have in common is we love to enjoy the area we live.  We could spend days cruising the back roads, seeing what others never see and just hanging out together.Today was no exception, we packed a picnic lunch - took the dog and headed out to see nature.  We knew from news-reports that only 3 of the local lakes were open due to snow.  South Twin, North Twin and Wickiup, we knew there would be snow but this kind of surprised us.Because Max (our wonderful million dollar lab) likes to get in the water there was not way we could stop and play with all the serious fishermen. So we headed down the road and found a great place for Max to play in the water.  Max is a great dog but he is lab through and through and will retreive until your arm feels like it will fall off.  He and I had a blast, Mike could not really trow the training dummy but he enjoyed it as much as we did.While we were playing in the water and having a great time we were blessed by the sight of an eagle.  Something that we occasionally get to see but never so close as today. This eagle kept swooping down and plucking fish from the lake.  I ran to grab my camera again and he became shy.  I was so bummed I really wanted to capture that guy to share with you.  Mike needed to get home his leg was starting to hurt so we packed up and on our way out - our eagle could be seen in a tree… he sat pretty for the camera - this is untouched but I had to share it with you…. isn't he beautiful?I loved my day off with the man of my dreams - it was wonderful to get out there and enjoy the area I love so much… I am ready for tomorrow -

The Furnishings - They Are Not Part of The DEAL
central oregon homes are often sought after by the second home buyers.  Many of these homes are sold furnished, which can be confusing to the lender, the buyer and the seller.  When furnishings are included they should NOT be part of the transaction.  Any value should be addressed outside of escrow - in our resort communities this can make or break a deal. A couple of years ago I listed a condo at about $50,000 over what both the seller and I knew an appraisal would come in at.  A lot of agents questioned our pricing, they thought we were out of line.  What they failed to realize is that we knew the appraiser could not add the furnishings to the appraisal and that there was no way an lender or appraiser could say that the $60,000 of furnishings had no value. Yes used furniture is not worth much, however, a furniture package that has been used for about 4 weeks at retailed at over $60,000 is worth a lot more than nothing. The condo sold for the asking price and did so quickly - however, the buyer did have to pay more than the home appraised for.  If you are a seller that intends to sell your home furnished, be sure to have an inventory and know that this can cause issues.  Buyers if you are looking to purchase a home furnished - be prepared to possibly have to come to the plate with a little more money or purchase the furnishings outside of escrow. Furnishings are considered personal property and a mortgage can not be placed on personal property. The mortgage is for the home which is real property.  Make sure your lender knows about the furnishings - and be certain your agent is familiar with the process of closing a home with furnishings, it can save you a lot of headaches.

I Thought I Might Get Rocks in My Pay Envelope
Some days being a real estate agent can really take it’s toll on a person’s patience.  In late March I wrote an offer for a cash buyer for a great lot.  There were a few contingencies but nothing out of the ordinary.  As buyers we did ask for the corners to be marked, and the building envelope to be marked.  These stakes had apparently disappeared with the melting snow. No big deal, we did not ask for the property to be resurveyed just simply remarked and the cost is generally around $150 - The day came that the listing agent called to say he would have the corners marked.  Buyer, myself and the listing agent (who is part owner of the land) met at the property - there were no markings. This was the first sign of an issue - but we got through it.  The prelim was a nightmare - both buyer and seller had common names almost as common as Smith.  We could get through this too, not a problem.  We were a week away from the closing day and I received a new prelim, the seller had sold the trust deed  changed ownership and LLCs- we had a new owner - they had changed the names of the seller…. the listing agent was not concerned and thought “we could just wing it.”  Winging it could mean all of my hard work was for nothing - there was no guarantee I would get anything more than a rock in my pay envelope. Not sure if he realized that at this point the listing was no longer valid, the contract for the sale was no longer valid and no one other than my buyer knew who was representing who.  The title company then informed me that my company does not put in a demand of commission when representing a buyer… I had no clue if a pay check would be coming or not… the new seller had not signed the listing contract - seemed to be avoiding signing the closing documents… and my buyer was anxious to close. Finally 3 weeks late - without a new listing agreement we closed, the seller never did sign the addendum adding them to the contract until closing - and yes I did get a paycheck - whew - think I will be suggesting a demand of commission to the owner and Principal Broker. To Buyers - having an agent that protects you is important - having an agent that understands our contracts is important.

Texas - My Home Away From Home - I Miss You
My phone started ringing last night with family members calling.  First my dad called, he wanted me to know he missed me and understood why I am not there, but the lighting bugs are flying and they are my calling card.  Then my sister Stacy called to say they were going to play poker and wished I was there.  Then Sheila called she had been Cat fishing which I love and agin she wished I was there. You see, up until about 4 years ago I had never seen my dad or a lighting bug and did not know I had 3 other sisters.  We celebrate our finding eachother every May.  May of 2004 was the first time I laid eyes on Texas and the first time I met my Texas family.  Since then every April or May and again in the fall I visit.  We catch up tell stories that many others have heard time and time again but they are totally new to me and mine to them. I generally am there for Mother’s Day - and tomorrow is Mother’s Day - and I am in Oregon.  Oh how I want to be in Texas - I want to see the lighting bugs, hug my sisters - play poker with my brother in law and just hang out with the family. This year with Mike being down, Oregon will have to do… maybe in the fall but I don’t want to get my hopes up. One of the great things about ActiveRain is I can always get a taste of Texas - have you noticed the great agents we have in Texas that are ActiveRain members.  Not sure where these guys were when I was thinking of moving to Texas… but sure glad I know them now - because if I did make that decision I know where to find a good agent.
