The Numbers Don’t Lie - Homes Are Selling - Buying Now is a Great Idea!


Yesterday I wrote about the market for first time home buyers in La Pine and Three Rivers South, Oregon. I was a little surprised to have a few locals chime in and basically disagree with me about the current market. The numbers do not lie - La Pine and Three Rivers South are showing signs of a down market - which I did not dispute, but what I did find is that neither are in a “declining” market.A declining market is when the sales prices fall below previous sales. Personal Property and real estate Sales
When you purchase a Sunriver vacation property often times it will come furnished. Generally this is the norm and it is just assumed to be acceptable. However this can cause issues with your loan or appraisal. All furnishings are considered personal property, a mortgage is on real property not personal property. Many of these furnishings truly have no value and stating so will often times put the lender at ease. There are times though when you have a newer home with a $50,000 furniture package that is included in the purchase price can cause problems.Appraisers are well aware of the way these properties are priced, and will not increase the value of the home to fit the contract. Their job is to appraise the REAL PROPERTY not the PERSONAL PROPERTY. So, how do we solve this problem if it comes up in your sale? There are many choices, the best is to adjust the contract to pay the appraised value and purchase the personal property outside of escrow and receive a bill of sale. Sometimes a simple addendum stating there is no value of the furnishings will work if the home appraises on it’s own. Regardless of how you take possession of the personal property there should always be a written inventory. These are time consuming and often times a REALTOR will not want to take the time to inventory a home. Many buyers are not aware that this is the standard practice of furnished homes. When you purchase your Sunriver real estate, using a local REALTOR can save you a lot of headaches, money and frustration. There are many more issues with purchasing a vacation rental that a local broker will know.I recently wrote a contract on a Sunriver vacation home, where the agent on the seller’s side did not want to take the time to inventory the home. Conditional Permits are NOT Just For Building
Conditional use permits (CUP) are for more than just building. Deschutes County along with most counties in Oregon have specific rules and regulations concerning what can and can not be done to or on the land surrounding our waterways.The reasoning is for this is not only to protect the view along the water with what types of structures are placed on the banks but how the wildlife will respond to such things. Many river front properties on the rivers in Deschutes County especially in La Pine, Three Rivers South and Bend are on the Big Deschutes. These properties often time have an area of wet lands on them. Most homeowners and buyers of these properties do not realize just how protected this area of their property is. I recently wrote a contract for a home with a large area of wetlands, my buyer and I did our due diligence and discovered just how restrictive the uses of this land can be.If part of your property is in wetlands in Deschutes County - can not do anything and I mean anything without a conditional use permit. This week in Three Rivers South (the Bulletin mistakenly calls it Sunriver) a home owner thought he was protecting his land by removing willows on the wetland area of his property. A tree had been hit by lighting during the summer and burst into flames. This homeowner hired a back hoe to come in and remove the willows, he was afraid the same thing would happen (my guess is he wanted to improve his view of the river).As a REALTOR in central oregon it is my duty to be sure that my clients, know where to find the land use rules and codes. If you are seeking riverfront or riverview property it is best to be sure what your view will be or can be. Do not assume that you can take out vegetation or build on all areas of your land, there are several restrictions that could cause you a head ache later. Comet In Our Skies | Sunriver The Perfect Place To See It!
It is not often we have the opportunity to see a comet, over the next couple weeks you will be able to see The Holmes comet. Earlier in the week you would have needed a telescope to see it. Now you can view it without a telescope.According to Lynn Carroll of the Sunriver Nature Center & Observatory it is not often that a comet will glow 1 million times brighter, but The Holmes Comet has done just that.The brightness of this comet is about the same as the stars in The Big Dipper. Because of the brightness, it can be seen even with the full moon we are currently experiencing. The Holmes Comet is orbiting between the path of Mars and Jupiter in the northeastern sky. Currently the comet looks like a big fuzzball according to Bob Grossfeld who is the director of Sunriver Observatory. This comet does not currently have a tail like the ones you may have seen in the past.The brightness this comet has shown was recorded 115 years ago, it is not known if it will grow brighter or dimmer over the next couple nights. The exciting part of this is if the weather holds, you can take a peek at this unusual event at the Sunriver Observatory. Tonight is the last regular night it is open, it will open for a few days around the holidays.If you are near Sunriver and would like to see The Holmes Comet up close and personal tonight is your night to go. The Sunriver Observatory will be open from 8 to 10 pm tonight you can use the telescopes to view Jupiter before it goes out ofsight for the evening as well as see the different constellations and The Holmes Comet.Not near Sunriver but want to see what is happening in space? Sportsman’s Warehouse Bend Oregon
Tonight my husband and I spent several hours at Sportsman’s Warehouse in Bend. My husband loves to go duck hunting every fall. A couple years ago I bought him a new shotgun for his birthday and last year we picked another one out and we purchased it. Over the last couple years the regulations have been changed so that when you hunt water fowl you must use steel shot instead of lead. As REALTORS we know the danger of children and lead based paint, so imagine what it would do sitting in the river.Back to what this has to do with real estate, CUSTOMER SERVICE. We went to Sportsman’s Warehouse with the intention of purchasing another shotgun. The gun my husband is using has too tight a pattern and it is ruining too much meat. I know those of you that do not enjoy hunting and are against it are bored to death by now, but bare with me there is a story related to us here.Shotguns have what is called a choke in it - you must use a choke or the steel shot will destroy the threads at the end of the barrel which are what hold the choke in place. We knew from the previous year his choke although the widest spread was still too tight and he had spent some time with this and found what is called a skeet tube, this morning was opening day of duck season in Oregon. At daylight he and Max were on the river waiting, ready and excited, only to be disappointed again. The ducks were flying and hunting was good, but they will be ground up into pepperoni as the shot was still too tight.My husband’s birthday is in two weeks, I thought well here comes shotgun #3 - but when we got to Sportsman’s Warehouse we were assisted by a great guy named Dave. Dave was more than willing to sell us a new shotgun, but when he heard why we were looking he said that there had to be a better solution.Dave pulled out some books, he read, he pulled other guns, he looked at the barrels, the chokes and spent 2 hours helping us. Dave helped us discover that although my husband’s gun is a Benelli which is a decent gun it is not designed to have a scatter effect. Even with the widest choke in it. However, he did help us also discover there is a choke made for this gun that is meant to give a better scatter. So, the moral of this story which is the same as real estate is - by providing a great service to your client, you will build the relationship. Guess where we will go for the next firearm we purchase. Oregon REALTORS Can Not Give Rebates!
Brokers in Oregon are not allowed to share their commission with an unlicensed person. Often times a seller, buyer or third party will ask for a payment for a referral or as a rebate at closing to give the buyer a bigger incentive to purchase a home.Some real estate offices and franchises across the United States have built their business on helping buyers buy a home by offering a rebate at closing. In Oregon this is not acceptable, if your real estate professional offers this, they are breaking the law.In 2007 this matter was reviewed and sponsored by Senator Winters. Changes were made to Senate Bill 673 which discusses the sharing of commission. To read the changes you can read it online at Senate Bill 673. The items in bold are the new and added verbabe to this bill, the state clearly states that sharing commission is unlawful.Other states have taken the same stand on sharing commission; they include Montana, North Dakota, Iowa, Kansas, Missouri, Oklahoma, Tennessee, Mississippi, Alabama, Louisiana, New Jersey and Alaska. The Department of Justice has a great website that talks about a lot of the questions that real estate Professionals and consumers alike have regarding Competition and real estate.
